Below are the terms and conditions for working caddies through Green Girls Golf LLC. By completing the Caddy Application Form at the bottom of this page you certify that you have read and accept these conditions of employment.
1.) Provision of Services:
Green Girls Golf LLC shall use its best endeavors to secure work of a nature for which the model is qualified in terms of ability and experience. Green Girls Golf LLC is under no obligation to offer or provide work to the model but may in its absolute discretion offer work as and when it sees fit. The model shall be under no obligation to accept any work that is offered by Green Girls Golf LLC, but upon accepting an assignment the terms of this agreement shall apply.
2.) Self Employment:
During any period that the model provides services to Green Girls Golf LLC’s clients, it is on a self employed basis and the model shall be responsible for the payment of all taxes and any other statutory payments that may be applicable. Where the model is registered for the model must take the necessary steps to comply with all statutory provisions and shall provide to Green Girls Golf LLC the registration number and such documentation as is necessary. The parties hereby acknowledge that neither is or shall at any time be a partner or employee of the other and that this is a contract for services as between Green Girls Golf LLC and the model.
3.) Fees and expenses:
Fees:
At the time of offering an assignment, Green Girls Golf LLC and the model shall agree the fee to be paid and Green Girls Golf LLC shall confirm the agreed fee in writing at the time of confirmation of the booking for the assignment. The fee shall be payable following presentation of an invoice by the model, which shall be done after the completion of the assignment and in accordance with the Payment Schedule. Payment by Green Girls Golf LLC shall be by bank transfer on the last Friday of every month.
Expenses:
Unless otherwise agreed in connection with an individual assignment, the model is expected to bear all reasonable travel subsistence and other expenses incurred in connection with the assignment. If in connection with an assignment the model is expected to travel beyond a reasonable travelling distance, Green Girls Golf LLC will normally seek to secure payment of travel expenses by the client.
Uniform Fee:
Effective July 15th, 2016 Green Girls Golf LLC is unveiling new uniforms and models will be required to provide a uniform fee so they can hold onto the uniform in between assignments. Upon acceptance of employment with Green Girls Golf LLC, the model will be provided with their uniform. The uniform fee of $35 dollars will be required by the model, prior to taking on any assignments, to mitigate the potential for a model to lose or damage their uniform. If you decide to no longer be an employee of Green Girls Golf LLC, or are terminated for any reason, you will return your uniform and be refunded your $35 uniform fee. You will not be scheduled for any assignments until your fee is paid.
4.) Assignments:
When confirming a booking, Green Girls Golf LLC shall provide the model with a briefing form informing the model of the anticipated number of days work and the start and finishing times of each day. The form shall provide a clear description of the services required by the Client, details of dress and other appearance requirements and all other pertinent details.
5.) Cancellation and non-availability:
Cancellation by Green Girls Golf LLC:
All Models should read all the following items carefully before becoming a Green Girls Golf Caddy.
Green Girls Golf LLC shall only be liable for payment of the model’s invoice once it has received full payment in cleared funds from the client. In the event of non- payment of Green Girls Golf LLC by the client, for whatever reason, Green Girls Golf LLC shall not be financially liable to the model.
At the conclusion of an assignment, the model must, within 24 hours; telephone Green Girls Golf LLC to provide such feed back as is required by Green Girls Golf LLC.
If a Client cancels or postpones a booking, Green Girls Golf LLC shall inform the model immediately. In the event of such cancellation, Green Girls Golf LLC shall be under no financial liability to the model as to reimburse any expenses reasonably and necessarily incurred by the model in anticipation of the cancelled assignment.
Cancellation by the Model:
If having accepted a booking, the model becomes unavailable to carry out the assignment; the model shall, in the case of bookings of 3 days or less, give Green Girls Golf Caddies LLC not less than 48 hours notice prior to the commencement of the assignment. If the assignment was expected to last more than 3 days the model shall give notice of cancellation equivalent to the duration of the assignment. If the model is unable to attend an assignment due to unexpected circumstances including ill health, the model must inform Green Girls Golf LLC immediately and in any event at least 12 hours before the start time of the assignment.
Non availability of the Model:
If the model knows of dates when he or she will not be available to provide services, they should be notified to Green Girls Golf LLC as far in advance as possible.
6.) Conduct during assignments:
During an assignment the model is expected to conduct himself or herself in a professional manner and not to engage in any activity which might damage the reputation of Green Girls Golf LLC or bring the name of the model or Green Girls Golf LLC into disrepute. The model shall at all times abide by the code of conduct annexed to this Agreement.
Models are expected to arrive promptly on each day of an assignment. In the event of late arrival on any day of an assignment, Green Girls Golf LLC shall at its absolute discretion be entitled to reduce the model’s fee by an amount equivalent to double the lost time calculated as a percentage of the total fee for the assignment.
7.) Interference with contracts:
Nothing in this Agreement shall permit or authorize the model to interfere with any contractual arrangements entered into by Green Girls Golf LLC with its clients. The model shall not make any decision that affects the activities of Green Girls Golf LLC or the contractual arrangements between Green Girls Golf LLC and its clients nor shall the model make representations on behalf of Green Girls Golf LLC to Green Girls Golf LLC’s clients or to any third party. If, during an assignment, the model is asked to do anything that amounts to a variation of the agreed terms of the assignment, he or she must immediately contact Green Girls Golf LLC who will discuss the proposed variation with the client and notify the model of the outcome of the discussions.
8.) Direct dealings with clients:
Nothing in this Agreement shall permit or authorize the model to enter into a contract or other arrangements directly with clients of Green Girls Golf LLC. If any of Green Girls Golf LLC’s clients seeks to initiate a contract, negotiate fees, arrange bookings or in any other way enter into direct dealings with the model, he or she must refer the Client to Green Girls Golf LLC and shall immediately notify Green Girls Golf LLC of the nature of the discussion.
9.) Freedom to work for others:
Nothing in this Agreement shall prevent a model providing services through other agencies or directly, provided that the model does not while on the books of Green Girls Golf LLC provide services to any of Green Girls Golf LLC’s clients with whom the model has worked or is booked to work under the terms of this Agreement.
Following termination of this Agreement, the model shall not for the period of 6 months accept an assignment with any of Green Girls Golf LLC’s clients with whom he or she has worked, without the written consent of Green Girls Golf LLC.
10.) Confidentiality:
The affairs of Green Girls Golf LLC and of its’ clients are strictly confidential. The model shall not, during this Agreement or at any time following its termination, disclose or permit to be disclosed or use for his or her own benefit or the benefit of any third party any confidential information that the model has acquired during the course of working for Green Girls Golf LLC and its clients.
This restriction shall only cease to apply when information ceases to be confidential by it entering the public domain, other than through a breach of this obligation on the model’s part.
11.) Health & Safety:
The model shall at all times when engaged on an assignment be responsible for his or her own health & safety. It is the model’s responsibility to familiarize herself with all written Health & Safety rules displayed at the premises at which the model is working, taking particular account of fire and evacuation procedures. If the model identifies any hazard or other risk during an assignment, he or she must immediately notify the client or the client’s representative and take such steps as are reasonable to avoid injury to him or herself or to others. Having brought such hazard or risk to the notice of the client or the client’s representative, the model must telephone Green Girls Golf LLC to confirm the course of action taken and to obtain such further instructions as may be necessary in the circumstances.
12.) Working Status:
In most cases assignments offered will be within the United States, however by signing this Agreement the model agrees to make herself available to work anywhere in the United States.
13.) Personal property:
The model shall be responsible for his or her own personal property at all times when engaged on an assignment and when travelling to and from assignments. Green Girls Golf LLC accepts no liability for any loss or damage to personal property, howsoever caused.
14.) Additional obligations:
The model acknowledges that Green Girls Golf LLC seeks to secure contracts based, among other things, on the model’s appearance. The model is therefore obliged to notify Green Girls Golf LLC if his or her appearance is in any way altered and specifically in the following circumstances:
a) Any cosmetic surgery
b) Pregnancy
c) Visible tattoo
In the event of pregnancy, the model must notify Green Girls Golf LLC if she is pregnant when an assignment is offered, even if the pregnancy is not noticeable. This is to ensure that the health & safety of the model is adequately protected.
15.) Images:
The model gives Green Girls Golf LLC permission to use all images taken via photography or film for any modeling/promotional or caddying work carried out for Green Girls Golf LLC to be used for promotional purposes.
